Welcome to Compliance Transport. These Terms of Service ("Terms") govern your use of the Compliance Transport website (compliancetransport.co.uk) and the software platform (app.compliancetransport.uk), collectively referred to as the "Service", operated by Compliance Transport Ltd ("us", "we", or "our").
Please read these Terms carefully before using our Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
1. Provision of Service
Compliance Transport provides a compliance, tracking, and management platform designed specifically for UK Local Authorities and their commissioned transport operators. Access to the core platform features requires a formal commercial agreement or enterprise contract between the Local Authority and Compliance Transport Ltd.
2. Accounts and Obligations
- When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
- You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.
- As a user representing a Local Authority or an approved Transport Operator, you confirm that you have the authority to process data within the platform and agree to uphold all data protection regulations applicable to your role.
3. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Compliance Transport Ltd and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Compliance Transport Ltd.
4. Data Processor Agreement
If you are a Local Authority using the Service to process personal data (including special category data such as SEND information), a separate Data Processing Agreement (DPA) must be executed alongside our main commercial contract. In all such instances, the Local Authority acts as the Data Controller, and Compliance Transport acts as the Data Processor under the Data Protection Act 2018 and UK GDPR.
5. Service Availability and Accuracy
We are constantly updating our offerings. We may experience delays in updating information on the Service and in our advertising on other websites. We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
While we strive for maximum uptime, we do not guarantee continuous, uninterrupted, or secure access to the Service. The Service may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications.
6. Limitation of Liability
In no event shall Compliance Transport Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorised access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
